Expósito Cáceres, of age, residing in Bda. Cruise, 42, 41240 Almaden de la Plata (Sevilla), in its own name and as a member of the Governing Board of the Natural Park Sierra Norte de Sevilla, on behalf of Ecologists in Action, hereby STATES:

That, regards the case of Transfer to the city of Almaden de la Plata of land in Melonares COMPENSATION AREA, specifically the plots 9-10 and 11, the polygon 11, bound for a Agroenergy PROJECT R & D IN VILLA Melonares, manifest following:

1 .- The project seems very interesting and quite possibly the future.

2 .- I understand that the location of such projects should be carried out on degraded land, or that do not cause the huge environmental impact that it will cause in the Melonares COMPENSATION AREA.

3 .- Melonares compensation area, was co-financed with EU funds, having invested in it, a huge amount of millions of euros, to create an ecological corridor linking the public lands in La Dehesa THE BERROCAL OF UPA, with a high environmental value.

4 .- For the installation in the ZONE COMPENSATION Melonares of that project would require:
a) .- power line and transformer station
b) .- Collection of water. (This project requires a large amount of water, being fast growing trees).
c) .- Installation of greenhouses.
d) .- Earthworks.
e) .- Arrangement Cortijo. (No draft thereof).
f) .- Civil Works.
g) .- transit of people and vehicles, both in operation, as in the development of the project. 5 .-

Compensation Melonares area is zone champions of the last LYNX detected in Sierra Morena.

6 .- Compensation Melonares area is the hunting ground of the Imperial Eagle, Bonelli's Eagle, Golden Eagle, Black Vulture, Osprey, Otters ... ..

4 .- The Naughty and the Observatory are granted by the Junta de Andalucía to the City Council, by agreement of the Governing Council of the Board on 5/10/1999. The period of assignment is for 10 years, renewable annually, if no complaint by the parties up to 50 years. Therefore it is impossible for the transfer of the management for 25 years.

5 .- The agreement of the Governing Council making the transfer to the town of Almaden de la Plata, at its Fifth, reads. "IS EXPRESSLY PROHIBITED LEASE AND TRANSFER OF PROPERTY." Therefore, any privatization of the management, would be illegal.

6 .- It is justified that the management has to be indirect (privatized management), and in this case illegal, from what I understand to be direct management by the council, which would benefit users, and one's own City Council, ie the people.

7 .- CLAIM Therefore, the management either directly by the municipality.

8 .- Claim is deleted from the text of the ordinance reference to the "winner."

8 .- Claim, consistent with the foregoing, is repealed ADMINISTRATIVE CLAUSES SPECIFICATIONS.

9 .- It is surprising (I use this description in the caution), a private company, GROUP ALUA specifically, is offering the services of both the Wicked, and the Astronomical Observatory on the Internet, without having been approved the ordinance, without having any kind of adjudication for the provision of the Service. 4 - In the fourth point of the Ordinance of operation, "management mode "There is no justification that the management has to be indirect (privatized management), so I understand the City of Almaden has direct management capacity, which will benefit users and the City Council, ie Village.
This is demonstrated by:

. If we make the calculation of occupancy of 75% of the seats, with 75% annual occupancy, would not give an income of 79,115.40 euros, therefore, with annual revenues of 67,316.40 euros (£ 11,219,624 .- .)
c. - If we add the benefits of home for the elderly and day stay, we would a profit of 456,532.59 euros (£ 76,090,286 .-). Therefore

5 .- Claim is deleted from the text of the ordinance any mention of "BIDDER."
6 .- no evidence in the record the decision of the Ministry in:
- Authorization of the Centre.

7 .- As a result, is repealed, see tender specifications.

8 .- It is at least surprising (when not using wisely otherwise qualified), and of doubtful legality, that the BOP n º 274, 10/11/2010, comes out to contest the award of the contract and meet the jury, without being finally approved and the tax, nor its founding and running the Centre, as they are in process to respond. Therefore not in force.
